Now Health International (Investments) Limited (collectively referred to in these Terms of Use as "NHI", "we", "us", "our”) owns and operates the Brokers’ Portal ('Portal'). A reference to NHI in these Terms of Use includes, where appropriate, a reference to Now Health International (Investments) Limited and its affiliates or group companies.
These Terms of Use ('Terms') govern your use of the Brokers’ Portal ('Portal') provided by NHI. These Terms will constitute a legal agreement between "you or You" (the user of the Portal) and NHI. Please read these Terms carefully before accessing or using the information and services available through the Portal.
By accessing or using the Portal, you agree to be bound by these Terms that are effective as of the date and time you use or access the Portal. If you do not agree to, or cannot comply with the Terms, please kindly refrain from using the Portal.
Access is granted solely to authorized brokers or intermediaries who have entered into a valid agreement with NHI/Insurer(s) in relation to international health insurance plans offered or administered or managed by NHI (the “Agreement”). Use of the Portal is limited to approved representatives or employees of authorized brokers or intermediaries who have received log in credentials.
You are responsible for maintaining the confidentiality of your account or login credentials and keeping the same secure. Any activity under your account will be considered as authorized by you. Notify NHI immediately of any unauthorized use.
The Portal must only be used for legitimate business purposes in accordance with the Agreement, including quoting, selling, enrolling, and servicing clients in respect of international health insurance plans offered or administered or managed by NHI. Any unauthorized use or misuse of the Portal is prohibited.
All information accessible through the Portal including client personal and medical details, pricing, coverage information, internal documentation and any proprietary information must be kept strictly confidential and secure. Such information must be used solely for the purposes related to the Agreement. You must not disclose such information to any unauthorized party.
You agree to handle all personal data accessed through the Portal in compliance with all applicable data protection laws and regulations including but not limited to the General Data Protection Regulation (GDPR) and any other relevant national or regional data protection laws and privacy regulations.
All personal information accessible through the Portal and provided by you will be processed in accordance with our Privacy Policy.
All intellectual property rights in the Portal, its contents, software associated with the Portal, underlying technology, design, logo and branding of the Portal (collectively, the “Portal Content”) is the exclusive property of NHI and is protected by copyright, trademark, and other intellectual property laws. This Portal is made available solely for use by authorized brokers in connection with their business relationship with NHI/Insurer(s) as per the terms of the Agreement. You may not copy, reproduce, modify, distribute, transmit, reuse any content or create derivative works without NHI’s prior written consent.
All intellectual property rights in the Portal Content, including but not limited to copyrights, trademarks, trade secrets, and proprietary information, remain vested in NHI or its licensors. Nothing on this Portal shall be construed as granting any license or right to use any intellectual property without the express prior written consent of NHI.
Unauthorized use or access to this Portal may result in disciplinary, civil, or criminal action.
You must not attempt to gain unauthorized access to any part of the Portal and its related systems or use it in any manner that could damage or impair system functionality or security. Suspicious or unauthorised activity may result in immediate suspension or termination of access.
You are responsible for ensuring that your actions via Portal comply with all applicable insurance, financial services and professional laws and regulations in your country or region. NHI is not responsible for any violations of such laws or regulations by brokers or intermediaries.
While NHI aims to provide uninterrupted access to the Portal, availability is not guaranteed. Access may be suspended for maintenance, upgrades, or technical issues without prior notice. NHI is not responsible for any loss or damage arising from Portal downtime.
NHI shall not be liable for any indirect, incidental, or consequential damages arising from the use of or inability to use the Portal.
NHI makes no warranties or representations to you as to the accuracy, authenticity or completeness of the content on the Portal, which is subject to change at any time without notice.
The material appearing on the Portal may include technical, typographical or photographic errors. NHI does not represent, warrant or endorse that any of the Portal content is accurate, complete, reliable or current. NHI may make changes to the materials contained on the Portal at any time without notice. You acknowledge that any reliance upon such Portal content shall be at your sole risk.
NHI is not responsible for any problems or technical malfunction of any network, computer online systems, servers or providers, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or on the Portal, including any injury or damage to any users or to any person's computer related to or resulting from participation or downloading materials in connection with the Portal.
NHI may suspend or terminate your access to the Portal at any time for violation or breach of these Terms, termination of your Agreement, regulatory issues or security concerns.
NHI reserves the right to modify or update these Terms at any time. Continued use of the Portal after such modifications constitutes your acceptance of the modified or updated Terms.
These Terms of Use are governed by and construed in accordance with English law. Any disputes arising from the use of the Portal will be subject to the exclusive jurisdiction of English courts.
